Terms & Conditions

1. JOSE MARÍA PÉREZ HERNÁNDEZ, of legal age, with DNI-NIF 43.376.790-D, as representative of FUN BIKE ADVENTURES, hereinafter the company, offers an electric bicycle rental service.
2. All customers will identify themselves with their valid ID card, proving the veracity of the documentation provided. A credit card will also be given as a deposit, from which any damage or theft of the rented bicycle and equipment will be charged.
3. The prices offered by FUN BIKE ADVENTURES are per person per electric bike.
4. Underage participants must be accompanied by their parents or legal guardians, who will be financially responsible for them in case of loss, damage or theft of the electric bicycle.
5. Electric bicycles can be booked/rented in person, by telephone, by email or via the website. The service fee must be paid before taking the bicycles. Cancellations must be made at least 24 hours before the date of delivery of the bicycle, as after this time the reservation/rental fee will not be refunded. If the rental is cancelled due to inclement weather, the amount of the activity will be refunded or a new date will be arranged. If the client is late, the company will allow a waiting time of 15 minutes, after which time the booking will be cancelled and no refund will be made.
6. This rental will have a fixed duration of 9 hours (from 10:00 to 19:00) and the bicycles will be collected and delivered at the established time.
7. The return of the rented bicycle and equipment shall be carried out at the place of rental, on the day and at the time indicated. Failure to comply with the delivery time will result in an additional charge to the customer of 10 euros per hour of delay. Failure to deliver on the day stipulated in this contract shall result in an additional charge of 100 euros/day. In the event of non-delivery, the company may take immediate possession of the electric bicycle in the place where it is located, without the right to any claim by the hirer and to charge the additional fee of the card provided as a deposit.
8. The rental customer receives the bicycle in perfect condition for use. Any complaint regarding the condition of the bicycle must be made at the time of delivery.
9. The customer is obliged to return the bicycle including the accessories provided, at the time and place previously established and always during the business hours of the company FUN BIKE ADVENTURES. The bicycle will be returned in the same conditions of use as at the time of delivery. The loss of components, theft or robbery of the bicycle or accessories, as well as damage caused by misuse of the bicycle must be reported at the time of return, which will be invoiced to the customer and charged to the credit or debit card provided by the customer as a deposit. It is not authorised to participate in championships or competitions.
10. In the event of an extension of the rental contract, this will require the approval of the company. The extension must be requested to FUN BIKE ADVENTURES before the expiry of the current contract. The extension can be refused by the company without justification.
11. It is the client's responsibility to respect the Spanish traffic laws and regulations and to drive with care and respect for pedestrians, as well as being responsible for any damage caused as a consequence of any accident while using the bicycle. The company is not responsible for any fines or penalties resulting from any infringement of these laws.
12. FUN BIKE ADVENTURES offers rental customers a protective helmet. FUN BIKE ADVENTURES advises you to wear this item for your own safety and it is mandatory in Spain. The non-use of the helmet by the customer cannot cause any liability on the part of FUN BIKE ADVENTURES.
13. The customer is obliged to take good care and take all necessary precautions to protect the rented bicycles and equipment from damage, loss or theft. Should any of the aforementioned situations occur during the rental period, the customer shall be immediately liable for the full replacement costs incurred at the rate or market price, depending on whether or not the part to be replaced is available at the company.
14. The bicycles and, where applicable, the rented accessories are fully approved and comply with all the safety measures and commercial guarantees required.
15. The customer declares to be in perfect health and able to ride a bicycle.
16. The company is not responsible for any possible wounds, injuries, fractures, illnesses, personal and/or material damage caused by the client or third parties; nor is it responsible for any possible fines that may be imposed on the client by the agents of the security forces of the State.
17. In the event of any fault in the bicycle during the rental period, FUN BIKE ADVENTURES will try as far as possible to replace it with the same or a similar model. If this possibility does not exist, the client will not be able to make any claim for damages and/or losses that may have been caused.
18. The customer understands and accepts that the use of an electric bicycle involves a physical risk to his health and even a risk of theft of the equipment. Notwithstanding the foregoing, by accepting these terms and conditions, the customer declares that he/she wishes to rent the electric bicycle and therefore assumes the risks referred to in the preceding paragraphs. The customer understands and accepts the risk of using this equipment and accepts legal and financial responsibility for any damage or injury he may suffer or cause to third parties.
19. For the resolution of any controversy or conflict arising in the application of this document, the Courts of Icod de los Vinos are designated.
20. In the event of a complaint or claim, the user may fill in the form provided for this purpose in our office.
21. This contract complies with and respects all the rights of consumers and users in accordance with the applicable Spanish legislation, an overview of which is published on the company's website for your information and consultation.

23. Purpose: The personal contact and bank details, provided and obtained throughout the relationship with JOSE MARIA PEREZ HERNANDEZ, will be used for the proper provision of the services of excursions and tourist activities and for the accounting and administrative management of the relationship with our customers.
24. Likewise, your data will be used to send you information about offers and promotions from JOSE MARIA PEREZ HERNANDEZ when you have given your authorisation to do so.
25. The owner of the data undertakes to communicate any modification that the data provided may undergo and to keep them completely up to date.
26. In the case of providing data of third parties, you must inform them of the communication of such data to JOSE MARIA PEREZ HERNANDEZ, as well as all the information relating to the processing of their data contained in this document.
27. Legitimation: We are entitled to process your data on the basis of: Article 6(1)(b) GDPR the processing is necessary for the performance of a contract to which the data subject is party or for the implementation at the data subject's request of pre-contractual measures; Article 6(1)(c) GDPR the processing is necessary for compliance with a legal obligation applicable to the controller.
28. Article 6.1. a) the data subject consented to the processing of his or her personal data for one or more of the specific purposes listed below: Authorises the use of his/her contact details for sending information about offers and promotions from JOSE MARIA PEREZ HERNANDEZ. Authorises the use of instant messaging applications to speed up communications. Authorises JOSE MARIA PEREZ HERNANDEZ to take your image in the excursions or activities carried out, and its subsequent dissemination on the website, social networks or any other medium for advertising purposes.
29. Recipients: Your data will be communicated to other professionals in the sector when it is necessary for the provision of the service. Likewise, your data will be communicated to your insurance company when it is essential for the invoicing of the service, as well as to the bodies required by law.
30. Rights: You may exercise your rights of access, rectification, deletion, opposition, portability and limitation, not to be subject to individualised decisions based solely on automated processing, or to revoke the consent given to JOSE MARIA PEREZ HERNANDEZ, at the address indicated above.
